§ 1 Scope and Provider
(1) These general terms and conditions apply to all bookings that you make with:

(2) The range of services is aimed exclusively at buyers who have reached the age of 18 or who have given us a declaration of consent from their legal guardians for minors.
(3) Our services and offers are based exclusively on these general terms and conditions. The general terms and conditions also apply to companies for all future business relationships, even if they are not expressly agreed again. The inclusion of general terms and conditions of a customer that contradict our general terms and conditions is already contradicted.
(4) The contract language is exclusively German.

§ 2 conclusion of contract
(1) After receipt of your customer request, you will receive an order confirmation from us. The e-mail with which we confirm that we have received your request (confirmation of receipt) does not yet constitute acceptance of your purchase offer. A contract is not yet concluded with the confirmation of receipt.
(2) A purchase contract for the service is only concluded when we expressly declare our acceptance of the purchase offer (order confirmation).
§ 3 prices
The prices stated on the website include the statutory sales tax.
Further costs will only be charged for special requests and discussed separately with you (e.g. carriage rides to the shepherd or tours from Egestorf, as well as winter trips to the heath).
§ 4 terms of payment; Default
(1) Payment is made in advance, either in advance with an invoice or after receipt of payment, with a payment confirmation. For short-term bookings, we choose to pay in cash on site. Only regular customers can receive a subsequent invoice.
(2) We are responsible for selecting the payment methods available in each case. In particular, we reserve the right to offer you only selected payment methods for payment.
(3) If you choose the invoice payment method, we will give you our bank details on the invoice. The invoice amount must be transferred to our account no later than 14 days before departure.
(4) If you choose the payment method in advance, we will give you our bank details in the order confirmation. The invoice amount must be transferred to our account up to 14 days after the start of the journey.
(5) If you fall into arrears with a payment, we reserve the right to assign the appointment to someone else. The tour is only firmly booked and binding for both parties once payment has been received.
§ 7 cancellation policy
In the event that you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), i.e. making a purchase for purposes that are predominantly neither commercial nor your independent professional activity, you have a right of withdrawal in accordance with the following provisions.
Right of withdrawal
You have the right to cancel or change this contract up to 14 days before departure without giving any reason. The total amount must be transferred no later than 14 days before the start of the journey. From that point on, no more changes are possible.

In order to meet the cancellation deadline, it is sufficient for you to send your notification that you are exercising your right of cancellation before the cancellation period has expired.

§ 8 final provisions
(1) The company generally works with selected partner companies and reserves the right to hire reliable, proper carriage drivers. Only drivers who have passed the heather coach driver certification are hired. In addition, all partner companies are monitored by an official veterinarian, and the carriages are TÜV tested. These drive on behalf of exclusive carriage rides, with their own teams and carriages.
(2) Booked trips that require a table or trips in style carriages will be adhered to as far as possible. This is recorded in writing in the order confirmation under "special arrangements". In the event of force majeure (e.g. illness or breakdowns), the company also uses other carriage models. A suitable replacement will be provided for wedding trips.
(3) Should any provision of this agreement be or become ineffective or should a loophole emerge, this shall not affect the effectiveness of the contract as a whole. Rather, the ineffective provision or the closing of the loophole must be supplemented by a regulation that comes closest to the intended purpose of the regulation. The place of fulfillment and jurisdiction for all rights and obligations arising from this contract is the seat of Exclusive Kutschfahrten Britta Alpers, insofar as both contracting parties are merchants or a legal entity under public law. German law applies.
